Our Terms of Service (what we call the “TOS”) make up the agreement between Trellis Health Systems, Inc. (“Trellis Health”) and you. These Terms govern your use and access to Trellis Health products, software, services, and website (including but not limited to text, graphics, images, and other material and information) as accessed from time to time by you, regardless if the use is in connection with an account or not (collectively, the “Services”).
Please read the TOS carefully, and any policies, guidelines or rules applicable to such Services, as they constitute a legal agreement between Trellis Health and you. We also encourage you to review our Privacy Policy for additional information. Of course, if you do not agree with our TOS or any other policies, then do not use the Services. You can delete your account from your Account Settings at any time.
I. Acceptance of Terms
Your use of the Services (excluding any services provided by Trellis Health Systems, Inc under a separate agreement) is subject to the terms of the legal agreement between you and Trellis Health Systems, Inc set forth in these Terms of Service ("TOS"). Except as specified herein, these TOS apply to any use of the Services, including but not limited to uploading or connecting Genetic Information, medical information, wearable devices and data, tracking or user generated data and interacting with it on the Trellis Health Systems, Inc website, web application or mobile app. In order to use the Services, you must first agree to the TOS. You may not use the Services if you do not accept the TOS. You can accept the TOS by (1) clicking to accept or agree to the TOS, where this option is made available to you by Trellis Health Systems, Inc for any Service; or by (2) actually using the Services. In this case, you acknowledge and agree that Trellis Health Systems, Inc will treat your use of the Services as acceptance of the TOS from that point onwards, during use.
- Prerequisites. You may not use the Services and may not accept the TOS if (1) you are not of legal age to form a binding contract with Trellis Health Systems, Inc, without parental or guardian consent or (2) you are a person barred from receiving the Services under the laws of the jurisdiction in which you are resident or from which you use the Services. In addition to the conditions above, if you contribute, connect or otherwise provide your own medical or health data you must be thirteen (13) years of age or older to agree to these TOS on behalf of yourself or those for whom you have legal authority to agree. If your use of the Services includes creating a Trellis Health Systems, Inc account, and provide your own Genetic Information, you must be eighteen (18) years of age or older to use the Services and accept the TOS.
- Description of the Services. The Services include access to the Trellis Health Systems, Inc public website, web application or mobile app. Unless explicitly stated otherwise, each new feature that augments or enhances the current Service shall be subject to the TOS. You acknowledge and agree that the Services are provided "AS-IS" and are based on the current state of medical and health knowledge in use by Trellis Health Systems, Inc at the time of the purchase, viewing or other use. As research progresses and scientific knowledge and technology evolve, Trellis Health Systems, Inc is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which Trellis Health Systems, Inc provides may change from time to time without prior notice to you. As part of this continuing innovation, you acknowledge and agree that Trellis Health Systems, Inc may stop (permanently or temporarily) providing some Services (or any features within the Services) to you or to users generally at Trellis Health Systems, Inc sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform Trellis Health Systems, Inc when you stop using the Services. Trellis Health Systems, Inc assumes no responsibility for the use of Services outside the terms of this TOS or other applicable terms.
In order to use the Services, you must obtain Internet access, either directly or through devices that access web-based content, and pay any service fees associated with such access. You are solely responsible for paying such fees. In addition, you must provide all equipment necessary to make such Internet connection, including a computer and modem or other access device. You acknowledge and agree that while Trellis Health Systems, Inc may not currently have set a fixed upper limit on the number of transmissions you may send or receive through the Services or on the amount of storage space used for the provision of any Service, such fixed upper limits may be set by Trellis Health Systems, Inc at any time, at Trellis Health Systems, Inc discretion.
II. Risks and Considerations Regarding Trellis Health Systems, Inc Services
Once you obtain your Medical or Genetic Information, the knowledge is irrevocable. You should not assume that any information we may be able to provide to you, whether now, as the Trellis Health Systems, Inc platform advances, will be welcome or positive.
We encourage you to talk to a genetic counselor or a health professional, if you have any concerns or questions about your medical situation.
You may learn information about yourself that you do not anticipate. This information may evoke strong emotions and has the potential to alter your life and worldview. These outcomes could have social, legal, or economic implications.
